My Desi Truck — Rental Agreement Terms
1. Booking Confirmation: Your booking is confirmed only after all three of the following occur: (a) this agreement is signed, (b) the booking is approved in writing by My Desi Truck, and (c) the 50% deposit is received and cleared. Submitting the booking form does not reserve your date. Dates are held for 48 hours after approval; if the deposit is not received in that window, the date is released.
2. Included Hours & Overtime: Each package includes up to 4 hours of service, measured from the agreed start time. A grace period of 15 minutes is allowed at no charge. Beyond that grace period, additional time is billed at $400.00 per hour, charged in full hourly increments. Overtime is calculated on site, is payable immediately on the day of the event, and is subject to driver availability - additional time cannot be guaranteed.
3. Deposit & Payment: A 50% non-refundable deposit is required to secure your date. The remaining balance is due no later than 14 days before the event date. Applicable state tax is added to all bookings. Payment is accepted by Zelle to 410-804-0291. No card processing fees apply. If the balance is not received by the due date, My Desi Truck may treat the booking as cancelled under the cancellation policy below and release the date. Any overtime incurred on the day is payable immediately after the event.
4. Cancellation & Rescheduling: Cancellations made more than 14 days before the event forfeit the deposit only. Cancellations within 14 days of the event forfeit the full booking amount. One reschedule may be requested more than 14 days out and will be honored subject to availability; the deposit transfers to the new date. No-shows and same-day cancellations by the client forfeit the full amount.
5. Driver & Operation: My Desi Truck provides a licensed, insured driver with the vehicle, unless otherwise previously agreed in writing. The vehicle is operated solely by our driver at all times. The client, their guests, and their vendors may not operate, move, or attempt to move the vehicle under any circumstances.
6. Route, Access & Timing: The client is responsible for securing venue access, route clearance, and any permits, road closures, or parking arrangements the event requires. Our driver has final authority to decline any route, surface, or maneuver deemed unsafe or likely to damage the vehicle. Rental time begins at the agreed start time regardless of client readiness.
7. Damage & Liability: The client is responsible for the cost of repairing any damage to the vehicle, its wrap, or its equipment caused by the client, their guests, vendors, or attendees - including scratches, dents, wrap tears, spills, or damage from items placed on or attached to the vehicle. Nothing may be affixed to the vehicle without prior written approval. The client agrees to indemnify and hold harmless My Desi Truck against claims arising from the client's or their guests' conduct at the event.
8. Conduct & Safety: No person may ride in the truck bed or on any exterior surface of the vehicle at any time. Occupancy is limited to the cab and to the seating capacity of the vehicle. Alcohol, smoking, open flames, and illegal substances are prohibited in and on the vehicle. Our driver may pause or end service without refund if conduct becomes unsafe, unlawful, or abusive toward the driver.
9. Weather: Service proceeds in ordinary weather. In the event of conditions our driver reasonably deems unsafe - including severe storms, high winds, flooding, ice, or snow - service may be delayed, modified, or suspended for safety. Where the event cannot safely proceed, the client will be offered a reschedule subject to availability.
10. Force Majeure & Service Failure: My Desi Truck is not liable for delays or cancellations caused by events beyond our reasonable control, including severe weather, road closures, accidents, civil disruption, or mechanical or electrical failure of the vehicle. If My Desi Truck cannot perform due to vehicle failure or driver unavailability, the client will be offered a reschedule or a full refund of all amounts paid, including the deposit. This refund is the client's sole and exclusive remedy, and My Desi Truck's total liability is limited to the amount paid for the booking. We are not liable for indirect or consequential losses, including other vendor costs or venue fees.
11. Media & Likeness: My Desi Truck may photograph or film the vehicle at the event and use such media for marketing and social media. The client may request in writing before the event that no identifiable images of the wedding party or guests be published, and we will honor that request.
12. Governing Law: This agreement is governed by the laws of the State of Maryland, USA, and the parties consent to jurisdiction in the courts of that state. If any provision of this agreement is found unenforceable, the remaining provisions remain in full effect.
13. Entire Agreement: This agreement, together with the confirmed booking details, constitutes the entire agreement between the parties and supersedes any prior discussions. Any changes must be agreed in writing by both parties.
